This apartment should never have been offered for rent

The apartment itself is perfect and would have been ideal. BUT see below - it should never have been offered.

This apartment should NEVER have been offered, as there was major construction in the apartment directly underneath, with jackhammer pumping from 8:20am onwards. Impossible to speak, think, read, sleep, watch TV, talk - it was overwhelming, in every single room, our heads literally exploded. We had to move into a hotel, it was a very distressing experience. The agency renting the apartment refunded the nights we did not stay and helped finding a hotel. But they should never have offered the apartment, as they were totally aware of the fact that the apartment underneath was a construction site.
